White paper: China´s domestic legislation strengthens judicial co-op

BEIJING, Feb. 28 (Xinhua) -- China turns international judicial cooperation into concrete rules via the domestic legislation, said a white paper issued by the Information Office of China's State Council on Thursday.

The paper said China's Civil Procedure Law rules that when there is discrepancy between domestic laws and international treaties joined by China, the people's court gives priority to international treaties in foreign-related civil law cases.

The paper noted that China's Extradition Law draws on the universally applicable principles for extradition cooperation between China and other countries.

China also enhanced judicial cooperation in combating crimes by offering help to gather evidence, freeze, seize and recover illegally-transferred proceeds of crime, and extradite and repatriate suspects on the run, said the paper.

In the last decade, China has carried out effective criminal judicial cooperation with some countries and international organizations, focusing on murder, embezzlement, bribery, terrorism, infringement of intellectual property rights and money laundering, said the paper.

According to the paper, up to October 2007, China had signed 98 bilateral treaties on judicial cooperation with 53 countries and joined over 20 multilateral conventions, including provisions of judicial cooperation.
